Smoke-Free Future?
The Government has published a draft Bill that could reshape how nicotine and tobacco products are sold locally. The proposed Smoke-Free Generation, Nicotine Products and Single-Use Vapes (Ban) Bill 2025 introduces a range of public health measures, and the GFSB wants your views, especially if you operate in retail, wholesale or vending.
What’s proposed
The draft legislation introduces three big changes:
- Smoke-Free Generation: From 1 January 2027, it will be illegal to sell tobacco to anyone born on or after 1 January 2009, even once they turn 18. This applies to both residents and underage visitors.
- Single-Use Vape Ban: All single-use vapes would be banned, including advertising them. Retailers could face fines of up to £5,000.
- Nicotine Controls: Sales of nicotine products (such as pouches or lozenges) would be restricted to those over 18, with signage requirements and vending machine regulations to follow.

Health Minister Gemma Arias-Vasquez said:
“The proposed legislation is an important step in our efforts to protect public health and the environment, while supporting a culture of wellness in Gibraltar.”
Why it matters
If passed, this legislation will affect a range of GFSB members, particularly those in retail, wholesale and vending. Some businesses may need to change signage, restructure inventory, or reconfigure sales processes, especially if single-use vape products are part of your offering.
What happens next?
The Government is seeking feedback from members. Retailers, wholesalers and anyone likely to be affected are encouraged to share views.
